Eligibility Requirements

Who is Eligible for Citizenship by Descent?

To be eligible to apply, you must generally meet all of the following:

  • Australian citizen parent — at least one of your parents must have been an Australian citizen at the time of your birth
  • Proof of parentage — you must provide legal evidence confirming your relationship to your Australian citizen parent
  • Identity — you must be able to verify your identity with appropriate documentation
  • Good character — applicants aged 18 and over must satisfy the good character requirement
  • Citizenship by descent limitations — if your Australian citizen parent also acquired citizenship by descent or by birth outside Australia, additional requirements may apply

In some cases, eligibility may depend on whether your parent spent time lawfully in Australia before your birth

  • Met in person — you must have met your prospective spouse in person at least once prior to applying
  • Intention to marry — you must genuinely intend to marry your partner within the visa period granted

Note: A citizenship ceremony is not required for citizenship by descent.

Your parent must have been an Australian citizen at the time of your birth. This can include citizenship by:

  • Birth in Australia
  • Conferral (naturalisation)
  • Descent

If your parent became an Australian citizen after your birth, you will not be eligible under this pathway.

Additional Requirements for Certain Parents

If your parent is an Australian citizen by descent or by birth outside Australia, you must also show that they:

  • Lived lawfully in Australia for at least 2 years at some point before your application

This requirement ensures a genuine connection to Australia across generations.

You must provide official documentation demonstrating your relationship to your parent, such as:

  • A full birth certificate showing both parents’ details
  • Adoption papers (if applicable)
  • Additional evidence if there are discrepancies or changes in identity

Where documentation is unclear or incomplete, further evidence may be required.

Applicants aged 18 and over must satisfy the good character requirement.

This includes assessment of:

  • Criminal history (in Australia and overseas)
  • Immigration compliance
  • General conduct and associations

Failure to meet the good character requirement may result in refusal.

Things to consider

Processing Times: Processing times can vary depending on the complexity of your application and whether additional information is required. Applications with complete and well-prepared documentation are generally processed more efficiently.

Application Fees: The current application fee for citizenship by descent is approximately $345. Fees are set by the Department of Home Affairs, are subject to change, and are generally non-refundable.

Evidence Requirements: Citizenship by descent applications rely heavily on documentation. Incomplete or inconsistent records, particularly relating to parentage or citizenship status, can result in delays or refusal.

If documents are issued overseas, they may need to be:

  • Officially translated into English
  • Certified or notarised
  • Supported by additional identity evidence

Complex Family Circumstances: Additional considerations may apply in cases involving:

  • Adoption
  • Surrogacy
  • Changes in parental identity
  • Disputed or unclear parentage

These cases often require tailored advice before applying.
